Terms of Service

1. The Service

UXScore is a software-as-a-service tool that allows you to create System Usability Scale (SUS) surveys, collect responses from participants, and generate reports. The Service is provided "as is" and is intended for business use. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with reasonable notice where practicable.

2. Your account

You must provide a valid email address to create an account. You are responsible for all activity that occurs under your account. Keep your magic-link emails confidential and notify us at support@uxscore.app immediately if you suspect unauthorised access.

You must be at least 18 years old and have the legal authority to enter into this agreement on behalf of yourself or the organisation you represent.

You agree not to use UXScore to:

• Violate any applicable law or regulation, including data protection laws when collecting survey responses from others.
• Upload or distribute malware, spam, or any content that is unlawful, harmful, or deceptive.
• Attempt to gain unauthorised access to the Service or its underlying infrastructure.
• Reverse-engineer, decompile, or create derivative works from the Service.
• Resell or sublicense access to the Service without our prior written consent.

We reserve the right to suspend or terminate accounts that breach these rules, with or without notice depending on severity.

5. Your data and intellectual property

You retain ownership of all data you upload to or create within UXScore (workspace names, projects, survey responses, etc.). By using the Service, you grant us a limited licence to store and process that data solely to provide the Service to you.

All intellectual property rights in UXScore itself — including the software, design, scoring methodology, and reports generated by the platform — belong to DOWLSOFT. Nothing in these Terms transfers any intellectual property rights to you beyond the right to use the Service as described.

6. Disclaimer and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose or uninterrupted availability. We do not warrant that the Service will be error-free or that any data will be preserved without loss.

To the maximum extent permitted by law, DOWLSOFT's total liability to you for any claims arising from these Terms or your use of the Service shall not exceed the total fees you paid to us in the three months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under applicable law.

7. Privacy

Our use of your personal data is governed by our Privacy Policy, which forms part of these Terms.

8. Changes to these Terms

We may update these Terms from time to time. We will give you reasonable notice of material changes — for example, by email or by displaying a notice in the application. Continued use of the Service after a change takes effect constitutes your acceptance of the revised Terms.

9. Governing law and disputes

These Terms are governed by the laws of Scotland and the rest of the United Kingdom. Any disputes shall be subject to the exclusive jurisdiction of the courts of Scotland, except where mandatory consumer protection laws in your country of residence give you the right to bring a claim before your local courts.
